Windows 2000 Terms of Service



TERMS OF SERVICE
HostSupreme reserves the right to suspend or cancel a customer's access to any or all services provided by HostSupreme when HostSupreme decides that the account has been inappropriately used or otherwise. HostSupreme reserves the right to refuse service and /or access to its servers to anyone.

SERVER USE
Accounts are to be used by the primary owner only. Account holders are not permitted to resell, store or give away web-hosting services of their website to other parties without formal consent from HostSupreme. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.  Customers violate our policy and the Services Agreement when they, their affiliates or subsidiaries engage in the following activities:


Adult Sites/Unacceptable Content – Pornography and pornographic related merchandising are prohibited under all HostSupreme’s Windows 2000 hosting services.  This includes sites that include links to pornographic content elsewhere.  Further examples of unacceptable content or links include pirated software, “hacker” programs, archives of “Warez Sites”, game rooms or MUDs, IRC Bots, Egg Drop programs, any kind of illegal software or shareware.  In addition sites offering online gambling, casino functionality, sports book betting (including offshore), and Internet lotteries are prohibited. 

 

Copyright Violation – Engaging in activity that infringes or misappropriates the Intellectual Property rights of third parties, including copyrights, trademarks, service marks, trade secrets, software piracy and patents and other similar rights held by third parties shall result in termination of all "subscribers" privileges on the "HostSupreme" system.

 

Customer Support – HostSupreme promotes a mutually professional relationship with its customers.  Obscene, abusive, threatening or otherwise harassing communications with agents of the Company, via telephone, email, online chat or other means will result in immediate account termination not withstanding any other terms of this agreement.  Violation of this will result in refund ineligibility.

 

Defamation -- Defamatory speech distributed over the Internet can result in civil liability for the defamer and litigation against the Web Hosting Provider (HostSupreme) whose facilities were used to distribute the defamatory material.

 

Distribution and/or Transmission of Obscene or Indecent Speech or Materials -- Violation of indecency and obscenity laws can result in criminal penalties.

 

Distribution of Internet Viruses, Worms, Trojan Horses and Other Destructive Activities -- Distribution of Internet viruses, worms, Trojan horses and other destructive activities, such as hacking, can result in serious civil and or criminal liability under federal and state law.

 

Illegal/Unauthorized Access to Other Computers or Networks -- The illegal or unauthorized accessing (often known as "hacking") of computers or networks carries potential civil and criminal penalties under both federal laws and the laws of most states/countries.

 

Image Repository - HostSupreme's windows platform hosting services are not to be used as a software/image repository.  This means you cannot use your account to store images that are pulled from another website.  An example of this would be storing images to be pulled from an eBay auction site.  HOWEVER, this is permitted on Linux and UNIX hosting plans and where formal consent is given by hostsupreme, on the windows hosting plans.

 

Software/Script Support – Customer acknowledges that HostSupreme cannot provide technical support for any software and/or script that the Customer installs, other than variable name changes.  Customer also acknowledges that HostSupreme does not supply technical support for Microsoft FrontPage, other than initial configuration.   HostSupreme supplies technical support for web hosting issues only.  HostSupreme shall be the sole arbiter as to what constitutes a “webhosting” issue.

 

Spamming -- Unsolicited, commercial mass e-mailing (known as "spamming") is a strongly disfavoured practice among Internet users and web hosting providers. It is particularly harmful not only because of its negative impact on consumer attitudes toward us, but also because it can overload our equipment and disrupt service to our customers.  This includes listing a hosted domain in any unsolicited email.

 

Un-metered Use Policy --   High bandwidth usage: HostSupreme offers an un-metered use policy by maintaining large ratios of bandwidth per customer. In rare cases, HostSupreme may find a customer to be using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. In such instances, HostSupreme reserves the right to impose the High Resource User Policy for the consideration of all customers.

 

Unlimited Web Space Policy -- HostSupreme provides the unlimited space in good faith to our Customers so that they may create their websites without the fear of running over their web space allocation.  While most Customers will use the extra web space for their legitimate web site needs, we recognize that others may try to take advantage of our offer and use the space and traffic in ways for which it is not intended. Customers are not permitted to store or make available any software, fixes, patches or electronic media (e.g. MP3s, AVI, WAV, etc.) for download on your site if hosted on the windows platform servers. We reserve the right - at any time, to permanently remove such content or terminate your service without refund.

In simple terms - no download sites on windows 2000 hosting plan(s).


High Resource User Policy -- Resources are defined as bandwidth and/or processor utilization.  HostSupreme may implement the following policy to its sole discretion:  When a website found to be monopolising the resources available, the site will be immediately suspended.  The account holder will then be contacted in order to discuss the situation. If no arrangement can be reached, HostSupreme reserves the right to terminate the customers account without refund.

PAYMENT POLICIES
All accounts are set up on a prepay basis. Although HostSupreme reserves the right to change prices of accounts or services at any time, all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year or month following the date the account was established. Customers will automatically be charged again at the end of their prepay period unless closure notification has already been given.
In situations where payment has not been received HostSupreme will immediately suspend the hosting. In addition, HostSupreme reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request.
No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via email.  Payments are accepted in the following currencies: Euro, GB Pound, US Dollar, Canadian Dollar and Australian Dollar.

Upon signing up for any of our hosting plans on a pay-monthly basis, you (the “subscriber” are obliged to continue your subscription for a minimum period of 12 succesive calendar months.  Should you break this agreement and wish to cancel your contract prior to the above period, you will be charged a penalty fee of £35. Charges will be waived at staff discression.).

PAYMENT OPTIONS
Credit Card/ Cheque Payment
HostSupreme cannot guarantee that a service will be provided until payment has been received and cleared. We will suspend all accounts where payment is not received. All accounts that require domain registration must be paid prior to account setup.

CANCELLATION AND REFUNDS
HostSupreme reserves the right to cancel the service at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of membership. It is the customer's responsibiltiy to terminate their hosting account by written cancellation request. Failure to do so will result in an account renewal after the prepaid period. If a customer contravenes HostSupreme’s terms of service a refund will not be issued in the event of a cancellation. Customers may cancel their account at any time, by giving 1 months notice in writing. Refunds will be given at the discretion of the HostSupreme Management.  Fees charged on a prepay basis are non-refundable once all months in the prepaid term have passed.

INDEMNIFICATION
Customer agrees that it shall defend, indemnify, save and hold HostSupreme harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against HostSupreme, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless HostSupreme against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with HostSupreme's server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from HostSupreme's server.

DISCLAIMER
HostSupreme will not be responsible for any damages your business may suffer. HostSupreme makes no warranties of any kind, expressed or implied for services we provide. HostSupreme disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non-deliveries, download speeds, availability, wrong delivery, and any and all service interruptions caused by HostSupreme and its employees. HostSupreme reserves the right to revise its policies at any time.
